1. Acceptance of these terms

These Terms of Service ("Terms") govern your use of the websites, apps, and games offered by Quack Quack Labs ("we," "us," "our"). By downloading, accessing, or using any of them, you agree to these Terms. If you don't agree, please don't use them.

2. Using our apps and site

Quack Quack Labs builds small apps and games for Apple platforms. We grant you a personal, non-exclusive, non-transferable, revocable license to use our apps and this site for your own personal, non-commercial use, subject to these Terms and any product-specific terms noted on that product's page.

3. Purchases, subscriptions, and the App Store

Apps are distributed through the Apple App Store, and your purchase, download, and use are also subject to Apple's applicable terms. Any prices, one-time purchases, or subscriptions are as described on the relevant product's page and in the App Store; billing, renewals, and refunds are handled by Apple under its policies.

4. Acceptable use

Please don't misuse our apps or site — including attempting to reverse engineer, disrupt, or gain unauthorized access to them, or using them in violation of any applicable law. We may suspend or discontinue any product or feature at any time.

5. Estimates and informational features

Some products provide estimates, scores, or informational features (for example, an estimated blood-alcohol level, or a wellness/coherence score). These are informational only, can be inaccurate, and are not measurement, medical, safety, or legal tools. Never rely on them to make decisions about driving, health, or safety. Each product's page carries its own disclaimer — please read it.

6. No warranties

Our apps and site are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

7. Limitation of liability

To the fullest extent permitted by law, Quack Quack Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of (or inability to use) our apps or site. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Changes to these terms

We may update these Terms from time to time. When we do, we'll revise the effective date above. Your continued use after changes take effect means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law rules.

11. Smart Sips — additional terms

Smart Sips shows an estimate of your Blood Alcohol Content, calculated from the drinks you log and your profile (the Widmark formula). It is not a breathalyzer, a measurement, a medical device, or a way to decide whether it is safe to drive or that you are under a legal limit. Your real blood-alcohol level may be higher or lower than the estimate, and a low or falling estimate is not permission to drive. If you have been drinking, do not drive. You use Smart Sips at your own risk, for personal awareness only, and you must be of legal drinking age in your location. Smart Sips gives no medical advice; if you or someone else may be in danger, contact your local emergency number.

Subscriptions. Smart Sips offers auto-renewing Monthly and Annual subscriptions, each with a free trial, and a one-time Lifetime purchase. Purchases are billed through your Apple account; subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and you can manage or cancel anytime in your Apple account settings. Current prices are shown in the app and on the App Store before you buy. These additional terms supplement the general Terms above and the disclaimer on the Smart Sips product page.
